Chapter 18 - The civil fraud complaint

Thomas sued Rachel and Ravel & Pine.
Not for being his daughter.
For:
Breach of fiduciary duty based on her role administering family account.
Fraudulent concealment of expanded usage.
Unjust enrichment.
Indemnification for guaranteed losses.
Accounting.
Rachel counterclaimed.
She argued:
Thomas knowingly permitted outside use.
Judith knew about commissions.
The family benefited from preferred rates generated by higher volume.
Ravel & Pine had performed real coordination.
All true to some degree.
This was not a clean theft case.
Then damages.
Thomas wanted:
Every commission Rachel earned.
His lawyers advised against assuming he was entitled to all.
She did real work for private clients.
