Chapter 2 - Ashley’s Video

The courtroom became so quiet I could hear the rubber tip of Ashley’s crutch squeak against the floor.
Judge Miriam Cole ordered the bailiff to bring her forward.
Preston Vale objected before Ashley had even reached the witness stand.
“This is an ambush.”
Ashley looked at him.
“No.”
She held up the phone.
“What happened to that baby was an ambush.”
The judge ordered a recess while attorneys reviewed the recording.
Kevin finally looked awake.
“What is on it?”
Ashley looked at me.
“The reason Noah fell.”
My stomach tightened.
The video had been recorded by a small camera Ashley kept in the nursery after she began suspecting someone was entering when she was away.
The timestamp showed 2:13 p.m.
Twenty-three minutes before Noah fell.
Vanessa entered the nursery.
Grant followed.
They were arguing.
“No more delays,” Grant said.
Vanessa whispered that Noah could get hurt.
Grant answered with a sentence that made every person in the room stop breathing.
“He only has to look hurt.”
The recording continued.
They moved Noah’s crib beside the open window.
Vanessa cried.
Grant told her the trust investigator was arriving the next week.
Then Ashley appeared in the doorway.
“What are you doing?”
The video shook.
Grant rushed toward her.
The next seconds were chaotic.
Ashley screamed.
A lamp shattered.
The camera fell sideways.
But it kept recording.
Grant dragged Ashley into the hallway.
Vanessa stood beside the window holding Noah.
Then the video ended.
Judge Cole watched it twice.
When court resumed, she did not issue the ruling everyone had expected.
She ordered the civil case stayed.
She ordered the video preserved.
Then she asked the prosecutor seated in the gallery to approach.
Grant shouted that Ashley was a liar.
Ashley stared at him.
“You broke my leg.”
Vanessa began sobbing.
Preston whispered urgently to his clients.
The judge ordered everyone silent.
I should have felt relieved.
Instead, I felt sick.
Noah had not crawled through an open window.
Someone had positioned him there.
The question was why.
Outside court, Ashley explained that she had been hospitalized after Grant shoved her down a service staircase.
The Caldwells told police she had fallen while stealing jewelry.
They threatened to prosecute her if she talked.
“Why come now?”
I asked.
Ashley looked ashamed.
“Because I was scared.”
Then she looked toward the courthouse doors.
“And because yesterday I learned they’re trying to get Noah back.”
“Back from where?”
“Protective custody.”
I froze.
Ashley leaned closer.
“Daniel, the lawsuit was never really about you.”
“What was it about?”
“Making everyone believe Noah’s injuries came from the rescue.”
“Why?”
Her answer changed the entire case.
